It's illegal for telemarketers to call this way. A bill collector is allowed to. Also, as for the statute of limitation, that would be 6 years of no activity. They are trying to collect, so it can go past the 6 years since there is activity (the collector trying to collect the debt is an activity). What should you do? Pay the $75 is the most obvious thing to do. But, on the other hand, if you actually work WITH THEM instead of against them, many times they are more than happy to reduce the amount you owe and called the case settled. Just make sure you get it in writing.
1. My credit card debt has gone past statute of limitations, can a collection agency keep calling for payment?
The first answer is correct. They can still ATTEMPT to collect on the debt, but they can not sue you and win IF you raise the SOL has an affirmative defense. Do like suggested and send a cease and desist letter, that will stop the harassment.
2. Should i send a debt validation letter to the collection agency or a letter claiming that I want a settlement?
Is this recent debt or is this debt that's a few years old and they are starting to harass you again? If it's recent debt....you should try to settle this issue as they have the power to take you to court if it's within the statute of limitations. The problem is..they do not like to do monthly payments...they want something up front... A template: I am willing to settle this matter for x% of the original amount. Your firm must send me a written agreement on your company's letterhead that you will accept this amount as "payment in full" and that is issue will be settled. Upon receipt of this agreement, I will mail you a money order for this amount.
3. i am looking for a healthcare facility or collection agency that contains ST MARY E and thats it.?
try looking under the new name covenant medical center or covenant lakeside. ST Mary was the name at one point
4. I am in total debt! I have a collection agency hounding me and I need to know what my best solutions are!!?
It will take a while for you to get sued. It's a long process. Most likey they will file suit and get a judgement against you. They can not take your school money as it's not income. They can garnish a checking account so do not send payments via check but via money order. Get a new checking account and never use it to send money to creditors. Use that for your student loan $$ if it does not go directly to a college. Tripping you out (quit doing weed and quit drinking...it worked for me) Send them a letter disputing the debt and read up on the FDCPA and then follow those guidelines on the websites. You can cut out the calls with a similar letter, requesting that you will only deal with them in writing. After that follow-up with a cease and desist letter noting you will only work with the original creditor. Consult a consumer protection attorney if it gets really bad. If they are out of line the attorney may be able to assist.
5. Collection agency's pay for delete e-mail sent to me?
Personally, I would only accept the agreement in letter form, via the USPS mail, signed by the authorized agent of the company
6. Can I be turned over to a collection agency while making regular payments to a business?
I live in Ga also and as long as you are making monthly payments to them they can do nothing. If a collection agency does damage your credit in any way you have legal rights to sue. Just keep good records and document everyone you speak to about this their name and what was said. I also agree with the people above me dispute all their charges and try and get a reduction in your bill Good Luck
7. What are the pros & cons of negotiating a balance with a credit card company vs. a collection agency?
If you pay while the account is active, it will re-start the SOL and will stay on your credit reports for 7.5 years. If you settle with a collection agency, they might report the different to the IRS for which you might get a 1099 which you would have to file taxes for 2012. If you are past due, I suggest you get it up to date and start making payments on time for the next 24 months. This will boost your credit score in the long run
