1. Plot of white furniture company

The Stack family of New York City has fallen on difficult financial times. Pa Stack squandered the family's money by buying a home in Newhall, California, hoping that there would be oil on the land.

Taxes are now due on the California home, which is scheduled to be sold to cover taxes. When breadwinner Mary Ellen Stack loses her job, the family decides to pay the taxes and live in their California home. They sell their furniture and use the money to buy a Tourist brand car, complete with rubber tires.

Before they leave, Pa tells Bill James, a former boyfriend of Mary Ellen, that they are moving to California, and Bill decides to follow them in his own car. When one of the family's car's tires goes flat, Bill catches up with the family and helps them. Along the way, the family picks up a handsome actor who is trying to come to California to further his career.

The Tourist Motor Car Company wants to use the first Tourist brand car ever made in an ad campaign, and launches a search to find it, complete with a $10,000 reward. The man who sold the car to the Stack family learns of the reward, tracks down the Stacks, and offers them $200 for it. Mary Ellen refuses the offer, but the salesman continues to negotiate with her.

Unbeknownst to her, Pa sells the car to a Mexican couple for $500. He returns to the family just as the salesman has raised the offer to $750. When the salesman hears that the car has been sold, he tells the family of the full reward, and pursues the new owners.

While driving through the west, the family is held up by bandits who rob them and let the air out of their tires. Bill comes to the rescue, and lends them his car while he fixes theirs. He is able reacquire the Tourist car and drives it to Newhall.

When he approaches the family, the brakes fail, and, unable to stop the car, he drives past them. When the car finally slows down, the actor accuses Bill of trying to steal the Tourist car. The two men fight while the family regains the car and drives off.

Bill realizes that they are in danger, and follows after them to warn them. The Stack family drives off the road into a fence, and all are fine. They are at their home.

2. At the Supreme Court of Canada of white furniture company

In a unanimous decision, the Court dismissed the appeal. In her ruling, Karakatsanis J agreed with the Court of Appeal's disposition of the matter, but argued that the "full appreciation test" placed inappropriate restrictions on the use of summary judgment: To that end, I conclude that summary judgment rules must be interpreted broadly, favouring proportionality and fair access to the affordable, timely and just adjudication of claims.

To that end, she gave guidance as to how it can best be used: Our civil justice system is premised upon the value that the process of adjudication must be fair and just. This cannot be compromised. The proportionality principle is now reflected in many of the provinces' rules and can act as a touchstone for access to civil justice.

The summary judgment motion is an important tool for enhancing access to justice because it can provide a cheaper, faster alternative to a full trial. The Ontario amendments changed the test for summary judgment from asking whether the case presents "a genuine issue for trial" to asking whether there is a "genuine issue requiring a trial". The new rule, with its enhanced factfinding powers, demonstrates that a trial is not the default procedure.

There will be no genuine issue requiring a trial when the judge is able to reach a fair and just determination on the merits on a motion for summary judgment. The interest of justice cannot be limited to the advantageous features of a conventional trial, and must account for proportionality, timeliness and affordability. Otherwise, the adjudication permitted with the new powersand the purpose of the amendmentswould be frustrated.

Where a party seeks to lead oral evidence, it should be prepared to demonstrate why such evidence would assist the motion judge in weighing the evidence, assessing credibility, or drawing inferences and to provide a "will say" statement or other description of the proposed evidence so that the judge will have a basis for setting the scope of the oral evidence. On a motion for summary judgment, the judge should first determine if there is a genuine issue requiring trial based only on the evidence before her, without using the new fact-finding powers. There will be no genuine issue requiring a trial if the summary judgment process provides her with the evidence required to fairly and justly adjudicate the dispute and is a timely, affordable and proportionate procedure.

Not all motions for summary judgment will require a motion for directions. However, failure to bring such a motion where it was evident that the record would be complex or voluminous may be considered when dealing with costs consequences. Absent an error of law, the exercise of powers under the new summary judgment rule attracts deference.

She also gave a rebuke to judges who expressed concern that the increased use of summary judgment would lead to more crowded dockets: While such an approach may complicate scheduling, to the extent that current scheduling practices prevent summary judgment motions being used in an efficient and cost effective manner, the courts should be prepared to change their practices in order to facilitate access to justice.

The Enemy Strikes Black referenced the controversy a year earlier when Arizona cancelled a state holiday for Martin Luther King Jr., and the NFL switched Super Bowl XXVII from Arizona to California, costing the state an estimated loss of over $100 million. A video of "By the Time I Get to Arizona", which was shown only once on MTV, depicted Chuck D killing Arizona officials with machine guns and a car bomb.

This violent behaviour attracted negative media attention, and was described by one newspaper columnist as being the opposite of what King died for. Anti-SemitismIn 1989, in an interview with Public Enemy for the Washington Times, the interviewing journalist, David Mills, lifted some quotations from a UK magazine in which the band were asked their opinion on the ArabIsraeli conflict. Professor Griff commented that "Jews are responsible for the majority of the wickedness in the world" (p.

 177), a quote from The International Jew. Shortly after, Chuck D expressed an apology on his behalf. At a June 21, 1989, press conference, Chuck D announced Griff's dismissal from the group, and a June 28 statement by Russell Simmons, president of Def Jam Recordings and Rush Artists Management, stated that Chuck D.

had disbanded Public Enemy "for an indefinite period of time". By August 10, however, Chuck D denied that he had disbanded the group, and stated that Griff had been re-hired as "Supreme Allied Chief of Community Relations" (in contrast to his previous position with the group as Minister of Information). Griff later denied holding anti-Semitic views and apologized for the remarks.

Several people who had worked with Public Enemy expressed concern about Chuck D's leadership abilities and role as a social spokesman. In his 2009 book, entitled Analytixz, Griff criticized his 1989 statement: "to say the Jews are responsible for the majority of wickedness that went on around the globe I would have to know about the majority of wickedness that went on around the globe, which is impossible . I'm not the best knower.

Then, not only knowing that, I would have to know who is at the crux of all of the problems in the world and then blame Jewish people, which is not correct." Griff also said that not only were his words taken out of context, but that the recording has never been released to the public for an unbiased listen. The controversy and apologies on behalf of Griff spurred Chuck D to reference the negative press they were receiving.

In 1990, Public Enemy issued the single "Welcome to the Terrordome", which contains the lyrics: "Crucifixion ain't no fiction / So-called chosen frozen / Apologies made to whoever pleases / Still they got me like Jesus". These lyrics have been cited by some in the media as anti-Semitic, making supposed references to the concept of the "chosen people" with the lyric "so-called chosen" and Jewish deicide with the last line. In 1999 the group released an album entitled There's a Poison Goin' On.

The title of the last song on the album is called "Swindler's Lust". The Anti-Defamation League (ADL) claimed that the title of the song was a word play on the title of the Steven Spielberg movie Schindler's List about the genocide of Jews in World War II. Similarly in 2000 a Public Enemy spin off group under the name Confrontation Camp, a name according to the ADL, that is a pun on the term concentration camp, released an album.

The group consisted of Kyle Jason, Chuck D (under the name Mistachuck) and Professor Griff. HomophobiaFear of a Black Planet's "Meet the G That Killed Me" described propagation of HIV. Upon its 1990 release, New York Times writer Peter Watrous criticized the song's lyrics as containing "stupidly crude" homophobia.

Zoe Williams defended Public Enemy against charges of homophobia, citing the same passage as Watrous: If you look at the seminal black artists at the start of hip-hop, Public Enemy and Niggaz Wit Attitudes, you won't actually find much homophobia. The only recorded homophobic lyric in Public Enemy's canon was: 'Man to man/ I don't know if they can/ From what I know/ The parts don't fit' a lyric from "Meet the G that Killed Me" on Fear of a Black Planet". Williams, Zoe, "Hiphopophobia", The Guardian, 29 April 2003
